Can the State lose its right to recover ill-gotten wealth from corrupt officials due to the passage of time?
The State maintains an absolute right to recover properties unlawfully acquired by public officials or employees. This right to recover ill-gotten wealth shall not be barred by legal technicalities such as prescription, laches, or estoppel. Consequently, the government can perpetually pursue these unlawful assets from the officials, their nominees, or transferees. This enduring right of the State is guaranteed under Article XI, Section 15, 1987 Philippine Constitution. “SECTION 15. The right of the State to recover properties unlawfully acquired by public officials or employees, from them or from their nominees or transferees, shall not be barred by prescription, laches, or estoppel.” 06-Mar-26About Nicolas and De Vega Law Offices
