Can supervisory employees join the rank-and-file collective bargaining unit?
Supervisory employees cannot become members of the collective bargaining unit intended for rank-and-file employees. However, they are not entirely deprived of their fundamental right to self-organization. They are expressly allowed to join, assist, or form separate collective bargaining units or legitimate labor organizations of their own. This separation, established in Article 255 Labor Code of the Philippines, prevents inappropriate supervisory influence over rank-and-file workers. “Supervisory employees shall not be eligible for membership in the collective bargaining unit of the rank-and-file employees but may join, assist or form separate collective bargaining units and/or legitimate labor organizations of their own.” 01-Jun-26About Nicolas and De Vega Law Offices
