Can one patent application cover more than one invention in the Philippines?
A single patent application can only cover multiple inventions if they form a single general inventive concept. Section 38.1, Intellectual Property Code of the Philippines, requires that the application relate to one invention only or to a group of inventions forming a single general inventive concept. If several independent inventions lacking such unity are claimed, Section 38.2, Intellectual Property Code of the Philippines, allows the Director to require restriction to a single invention and permits divisional applications that keep the original filing date if filed within specified time limits and without adding new matter.
