Can an applicant withdraw a previously filed request for substantive examination and obtain a refund?
An applicant may withdraw a request for examination, but that withdrawal is final and does not entitle the applicant to any refund. Section 48.2, Intellectual Property Code of the Philippines, provides that withdrawal of the request for examination shall be irrevocable and shall not authorize the refund of any fee. This discourages speculative filings and administrative inefficiencies.
