Can a utility model be cancelled due to issues with the description or claims?

  Yes, a utility model registration can be cancelled if the description and claims do not comply with the prescribed legal requirements. This authority is found in Section 109 Intellectual Property Code of the Philippines. The law requires that the technical details be clearly and sufficiently disclosed to the public. Failure to provide necessary drawings for understanding the invention is also a ground for cancellation.   “109.4. …the utility model registration shall be cancelled on the following grounds: … (b) That the description and the claims do not comply with the prescribed requirements; (c) That any drawing which is necessary for the understanding of the invention has not been furnished;”   January 3, 2026
