Can a petition for legal separation be denied if both parties have given ground for it?

The legal doctrine of “clean hands” applies heavily to petitions seeking a formal legal separation. If the court finds that both parties have actively given ground for legal separation, the petition will be denied. The law does not reward a spouse who is equally guilty of committing marital offenses. This mutual fault restriction is established in Article 56 Family Code of the Philippines. “Art. 56.
