Can a party terminate a collective bargaining agreement during its lifetime?
An existing collective bargaining agreement is a highly protected binding contract that must be respected for its duration. When there is an existing agreement, the duty to bargain collectively dictates that neither party shall terminate nor modify such agreement during its lifetime. The negotiated terms are considered locked in to ensure continuous industrial stability. This principle of contract sanctity is found in Article 264 Labor Code of the Philippines. “ART. 264.
