Can a non-union member be charged agency fees?
Yes, non-union members can be legally required to contribute to the union’s collective bargaining efforts. Employees in the appropriate bargaining unit who are not union members may be assessed a reasonable fee. This fee is strictly equivalent to the dues paid by recognized members, provided the non-members accept the benefits under the collective bargaining agreement. This assessment of agency fees is authorized by Article 259 Labor Code of the Philippines. “Employees of an appropriate bargaining unit who are not members of the recognized collective bargaining agent may be assessed a reasonable fee equivalent to the dues and other fees paid by members of the recognized collective bargaining agent, if such non-union members accept the benefits under the collective bargaining agreement” 01-Jun-26About Nicolas and De Vega Law Offices
