Can a new province or city be created simply by passing a law? The creation of a new province, city, municipality, or barangay clearly requires more than just the passage of a standard law. It must be done in strict accordance with the criteria established in the Local Government Code regarding population, income, and area. Furthermore, the creation must be definitively approved by a majority of the votes cast in a plebiscite by the people directly affected. This democratic requirement for structural territorial changes is stated in Article X, Section 10, 1987 Philippine Constitution. “SECTION 10.
