Can a licensor fix the resale price of products made under a license?

  A licensor is generally prohibited from reserving the right to fix sale or resale prices for the licensee’s products. Such clauses are viewed as damaging to free market competition. This restriction ensures that the licensee maintains some commercial independence. This rule against price-fixing is stated in Section 87 Intellectual Property Code of the Philippines.   “87.2. Those pursuant to which the licensor reserves the right to fix the sale or resale prices of the products manufactured on the basis of the license;”   January 3, 2026
