Can a legal separation case be tried immediately after filing?
The court is strictly prohibited from immediately rushing into a trial for a legal separation case. A mandatory cooling-off period must be faithfully observed before any formal trial proceedings can commence. Specifically, the case cannot be tried before six entire months have elapsed since the filing of the petition. This required waiting period is mandated by Article 58 Family Code of the Philippines. “Art. 58. An action for legal separation shall in no case be tried before six months shall have elapsed since the filing of the petition. (103)” 31-Jul-26About Nicolas and De Vega Law Offices
