Can a decree of legal separation be based on a stipulation of facts?

Spouses are absolutely not allowed to bypass the legal process by merely stipulating facts or agreeing to separate. The law firmly states that no decree of legal separation shall be based upon a stipulation of facts. Furthermore, it cannot be based on a mere confession of judgment by the guilty respondent. This strict evidentiary rule to prevent easy separation is found in Article 60 Family Code of the Philippines. “Art. 60. No decree of legal separation shall be based upon a stipulation of facts or a confession of judgment.” 31-Jul-26
