Yes, the National Privacy Commission, exercising its potent quasi-judicial functions, possesses the legal authority to formally award financial indemnity to an aggrieved party. This awarded restitution for damages is solidly based upon the applicable and established provisions of the New Civil Code of the Philippines. Typically, any formal complaint actively filed by a damaged data subject requires the payment of filing fees unless they are a certified indigent. This compensatory mechanism is completely codified under Section 64 IRR. “Section 64. Restitution. Pursuant to the exercise of its quasi-judicial functions, the Commission shall award indemnity to an aggrieved party on the basis of the provisions of the New Civil Code.
