Trademark Registration in the Philippines

Your trademark is the core of your business since it represents the goodwill and reputation of your products and services.  For this reason, it is necessary, nay, indispensable to have your trademark protected.  This can be done easily, with or without the assistance of a lawyer.  Here are the three (3) simple steps to register your trademark.

STEP 1

You may file and pay for your application online  at https://ipophil.gov.ph or you may personally file it at the Philippine Intellectual Property Office (IPO) at #28 Upper McKinley Road, McKinley Hill Town Center, Fort Bonifacio, Taguig City. Details required in the application form are your name, address, specimen of the trademark, and the corresponding goods or services covered.  Filing fee is P1,212 for 1 class (P2,618 if you are a big entity).

STEP 2

If you receive a Registrability Report from the IPO, you must file a response to it within two (2) months from mailing date.  If the IPO has no objections, it will issue a Notice of Allowance.  Make sure to pay the fees (P1,485 for small entity P2,182 for big entity)  under the Notice of Allowance within two months from mailing date. 

STEP 3

Your application will be published for 30 days in the IPO website.  If there is no opposition, the IPO will issue to you a Certificate of Registration.
